Subscription agreement

This agreement is between Bimodal Ltd (“we”, “us”) and the person or business creating a HoroBench workshop account (“you”). Bimodal Ltd is registered in England and Wales, company number 13964513, at 128 City Road, London, EC1V 2NX. Contact us at hello@horobench.com.
1. Your account and plan
Creating an account starts a free Hobby plan when registration is open. Hobby permits one workshop user and two new service jobs each calendar month; existing jobs remain accessible. There is no card entry, paid trial, automatic paid conversion or recurring HoroBench charge in this sign-up journey. The current allowances are shown on our plans page.
Workshop and Workshop Pro are managed plans. If you want a paid plan, we will confirm its price, billing period, start date and any special terms with you separately before you incur a charge. A workshop’s Stripe connection for collecting its own customer invoices is distinct from a HoroBench subscription.
2. Using the service
You must provide accurate account details, keep credentials secure and ensure that invited users are authorised. You are responsible for records and messages entered by your workshop, for lawful use of customer information, and for checking quotes, invoices and customer communications before sending them. Do not use HoroBench to break the law, access another workshop’s information or disrupt the service.
3. Customer data and privacy
You control the customer and job information your workshop enters. We process it to provide and support HoroBench, including hosting, storage, transactional email and connected payment functions you choose to use. Our data processing terms form part of this agreement for that customer data. Our privacy notice describes how we handle personal information. You remain responsible for giving your customers appropriate privacy information and for deciding what to share through customer links.
4. Availability and changes
HoroBench is under active development. We may update features and reasonable usage limits as the service evolves. We will give notice of material changes that adversely affect your use where practical. We do not promise uninterrupted availability or that every feature is suitable for your particular legal or accounting requirements.
5. Leaving HoroBench
You can stop using the free plan and request account closure by emailing hello@horobench.com. You can export core workshop records from Settings while your account remains active; contact us about other records. We may suspend access for security, misuse or legal reasons, or where a separately agreed paid subscription requires it. We will handle records after closure in line with our privacy notice and applicable law.
6. Responsibility and disputes
We are responsible for providing HoroBench with reasonable care and skill. Nothing in this agreement excludes liability that cannot legally be excluded, including liability for fraud or negligence causing death or personal injury. Otherwise, neither party is responsible for losses that were not reasonably foreseeable when this agreement began. Any paid-plan liability terms must be agreed separately before that plan starts.
English law governs this agreement, subject to any mandatory rights you may have under the law where you live. If a concern arises, please contact us first at hello@horobench.com so we can try to resolve it.
